3. Description of Service

Mozify is an AI-powered video creation platform designed to provide users with authentic talking head videos that synchronize emotions, gestures, and speech patterns for natural human expression. Our services may include, but are not limited to, custom avatar creation, video generation, content recommendations, and interactive features that enhance user experience for marketing, education, and entertainment purposes.

4. Eligibility

By using Mozify, you represent and warrant that you are at least 13 years of age. If you are under the age of 18, you may only use Mozify under the supervision of a parent or legal guardian who agrees to be bound by these Terms. Users suspended or removed from Mozify are not eligible to use our services.

5. User Accounts

To access certain features of Mozify, you may be required to create an Account. When creating an Account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use or suspected breach of security.

6. User Conduct

You agree to use Mozify responsibly and in compliance with all applicable laws and regulations. You shall not:

• Engage in any activity that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Impersonate any person or entity or misrepresent your affiliation with a person or entity.
• Upload, post, transmit, or otherwise make available any content that you do not have a right to make available under any law or contractual relationship.
• Use Mozify to distribute unsolicited promotional or commercial content, spam, or other mass communications.
• Interfere with or disrupt the integrity or performance of Mozify or the data contained therein.
• Attempt to gain unauthorized access to any portion of Mozify, other user accounts, or any systems or networks connected to Mozify.

7. Acceptable Use Policy

Mozify is committed to maintaining a respectful and lawful environment. You agree not to generate or share content that:

• Promotes or incites violence, hate speech, or discrimination against any individual or group based on race, religion, ethnicity, gender, sexual orientation, disability, or any other characteristic.
• Contains sexually explicit, pornographic, or adult material.
• Encourages or facilitates illegal activities, including but not limited to drug trafficking, human trafficking, or any form of exploitation.
• Infringes upon the intellectual property rights or privacy rights of others.
• Includes malicious software, viruses, worms, Trojan horses, or any other harmful or destructive content.
• Provides unauthorized access to data, systems, or networks belonging to Mozify or any third party.
• Violates any applicable local, state, national, or international law or regulation.

8. Intellectual Property Rights

All rights, title, and interest in and to Mozify and its content (excluding User-Generated Content) are and will remain the exclusive property of Mozify and its licensors. The app is protected by copyright, trademark, and other laws of the United States and foreign countries. You agree not to use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell, or otherwise exploit for any purposes whatsoever any content or third-party submissions or other proprietary rights not owned by you without the express prior written consent of the respective owners.

9. User-Generated Content

You may submit, post, or display content through Mozify ("User-Generated Content"). You retain all rights to your User-Generated Content. By submitting content, you grant Mozify a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User-Generated Content in connection with Mozify's services.

You represent and warrant that you have all rights, power, and authority necessary to grant the rights granted herein to any User-Generated Content that you submit.

10. Payment and Subscriptions

Certain features of Mozify may require payment or subscription ("Paid Services"). If you choose to access Paid Services, you agree to the pricing and payment terms. Payments are processed securely through our third-party payment processor. By making a purchase, you agree to comply with the payment processor's terms and any applicable laws and regulations.

You are responsible for providing accurate billing information and updating it as necessary. Failure to comply may result in the suspension or termination of your Paid Services.

11. Free Trials and Promotions

We may offer free trials or promotional offers from time to time. Such offers are subject to these Terms and any additional terms provided in connection with the offer. We reserve the right to modify or terminate any free trial or promotion at any time, without notice.

12. Refunds and Cancellations

13. Prohibited Business Activities

You are prohibited from using Mozify for any activities involving:

• The sale or promotion of physical products or services unrelated to Mozify's offerings.
• Human services not related to software (e.g., consulting, legal advice).
• Payment processing without a bona fide software or service sold, including donations or crowdfunding unrelated to Mozify.
• Any product or service that infringes upon intellectual property rights, including unauthorized resale, illicit streaming services, or software used to bypass security measures.
• Unauthorized access to data belonging to another party, including spyware, hacking tools, or keyloggers.
• Adult content, pornography, or sexually explicit material.
• Gambling, betting, lotteries, or any games of chance involving monetary or material prizes.
• Financial services, trading platforms, money transfer services, or virtual currencies.
• Medical or legal advice, pseudo-science services, or any form of unlicensed professional services.
• Activities that violate any applicable laws, regulations, or our acceptable use policies.

Violation of these prohibitions may result in immediate termination of your Account and access to Mozify, and may subject you to legal penalties.

14. Disclaimer of Warranties

Mozify is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the availability, reliability, or accuracy of Mozify or any content provided through the app. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Mozify and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use Mozify. In no event shall the aggregate liability of Mozify exceed the amount you paid to us, if any, in the past six months for the services giving rise to the claim.

16. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of your country, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms shall be instituted exclusively in the federal or state courts. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

17. No Professional Advice

Mozify does not provide medical, legal, financial, or any other form of professional advice. The content generated should not be used as a substitute for professional consultation. Always seek the advice of a qualified professional with any questions you may have regarding a specific issue.

18. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use Mozify after those revisions become effective, you agree to be bound by the revised Terms.
